GENERAL TERMS AND CONDITIONS
INTRODUCTION
The following General Terms and Conditions govern the contractual relationship between the "Customer" and Dimora Italia brand of the company Views on Venice Srl (hereinafter referred to as Dimora Italia), following the booking and payment of the accommodation selected from those present on the www.dimoraitalia.com portal, directly or indirectly through any device. More specifically, the following General Terms and Conditions govern the agreement between Dimora Italia and the Customer, who books and purchases our services on the website and who signs the transient rental agreement stipulated between the Customer and Dimora Italia, acting in its own name and on its own behalf, and related to the chosen accommodation. The customer is required to accept these General Terms and Conditions, as well as the specific conditions relating to the stay or individual services (such as duration, price of the rental and related booking fees, applicable taxes, and regulations in force). The customer is, therefore, required to read in full the General Conditions and Terms and any conditions applicable to individual services available on the Site, before booking. By making a reservation or purchasing the service offered and signing the transient lease agreement for the requested property, you automatically accept the General Terms and Conditions described herein. The General Terms and Conditions may be modified at any time, without prior notice, but it is understood that such changes will not apply to orders placed by the customer before the change.
RESERVATION
a) Two booking categories are possible: Instant Booking (online booking) and Availability Request (by email or phone).
b) In the first case (Instant Booking) you will receive an automatic confirmation message from Dimora Italia, once the payment has been made in accordance with the methods indicated below.
c) In the second case (Availability Request), you will receive an e-mail reply within two working days with the availability of the chosen apartment. After receiving confirmation of the availability of the chosen apartment, the Customer must then make the reservation through the form sent by Dimora Italia and make the payment in accordance with the Methods indicated below.
d) In both cases, you must fill out the "Registration Form". The information requested is necessary for the completion of the booking procedure and it is in any case processed in compliance with the privacy regulations.
e) Dimora Italia reserves the right to refuse a booking at its discretion.
f) The lease of the apartment will automatically cease at the end of the period established at the time of booking.
PAYMENT METHODS
The Booking includes separately the rental fee, the related booking fees as well as the final cleaning costs; The total amount must be paid in the following ways:
a) 40% of the rent and booking fees must be paid at the time of booking;
b) The balance must be paid at least 30 days before the rental period. If the reservation is made after this deadline, the total amount must be paid immediately and therefore at the same time of the booking.
c) If the client intends to pay by bank transfer, the payment must be made according to instructions provided by Dimora Italia by e-mail confirming the availability of the chosen apartment, which stipulate that a copy of the bank transfer slip must be forwarded by email to Dimora Italia within 4 working days from the day of booking.
REVOCATION OR ANNULMENT BY THE CUSTOMER
a) VENICE
The cancellation policies are visible in the information sheet of each individual apartment once the period of stay has been selected. Except for the opening week of the Biennale as well as some extra-luxury apartments, cancellation by the Client, for any reason, will apply the following penalty: if the cancellation is made within 30 days before the date of arrival: 40% of the total amount; - If the cancellation is made within 14 days before the date of arrival: 100% of the total amount.
b) FLORENCE
The cancellation policies are visible in the information sheet of each individual apartment once the period of stay has been selected. Will apply the following penalty: if the cancellation is made within 30 days before the date of arrival: 40% of the total amount; - If the cancellation is made within 14 days before the date of arrival: 100% of the total amount. For cancellations of reservations with stays from November 1st to December 20th and from January 6th to March 31st, will apply the following penalty: If the cancellation is made within 14 days before the date of arrival: 100% of the total amount.
c) ROME
The cancellation policies are visible in the information sheet of each individual apartment once the period of stay has been selected. Cancellation by the Client, for any reason, will apply the following penalty: if the cancellation is made within 30 days before the date of arrival: 40% of the total amount; - If the cancellation is made within 14 days before the date of arrival: 100% of the total amount.
d) Please notify your cancellation in writing by e-mail to info@dimoraitalia.com.
CANCELLATION BY DIMORA ITALIA
a) If Dimora Italia is unable to provide the Customer with the chosen apartment for supervening reasons beyond its control, the Customer will be informed as soon as possible, indicating another available apartment having similar characteristics and conditions to those of the chosen accommodation;
b) If another apartment with similar characteristics and conditions to those of the chosen accommodation is not available or if the Customer does not intend to accept the proposed change, the booking will be cancelled and the Customer will have the right to request a refund of paid amounts, without any further claim and penalty against Dimora Italia.
FORCE MAJEURE
Force Majeure invoked by the Customer
If the Customer was unable to enjoy the booked stay fully or partially due to force majeure events, Dimora Italia will issue a voucher equal to the amount of the booked rental, net of non-refundable expenses, valid for one year to be used upon rebooking.
Force Majeure invoked by Dimora Italia
If the fulfilment by Dimora Italia is prevented by unforeseeable events outside its sphere of action, the Company may refuse and/or interrupt and/or suspend the execution of the contract, and issue to the Customer a voucher, valid for one year, equal to the amount already paid, to be used upon rebooking.
Force Majeure Communication
In both cases of force majeure, the interested party is required to promptly notify the other party in writing of the impossibility to use the booked stay, specifying the relevant and specific reasons.
DEPOSIT
a) The security deposit (whose amount is expressly indicated next to the amount provided for the stay at the chosen apartment), required to the Customer as a guarantee for any damage that may be caused to the apartment or its furnishings and/or equipment during the period of stay, must be provided by the Client authorizing the "block" of the relevant amount on their credit card and in favour of Dimora Italia which will "unblock" it only after the release of the apartment at the end of the stay and once it has been ascertained that no damage has been caused to the apartment or its furnishings and/or equipment. The time needed to "unlock" the security deposit may vary depending on the credit institution.
b) If damage to the apartment or its furnishings and/or equipment is ascertained, Dimora Italia is authorized to withhold, in whole or in part, the security deposit, communicating to the Customer : 1) the list of damaged goods and their value; 2) the persons to whom the relevant compensation is to be paid; 3) the deadlines for the relevant payment or the authorization to withhold the corresponding sum from the security deposit specifically constituted.
ARRIVAL AND DEPARTURE
a) The Customer must inform Dimora Italia of his/her arrival time at least 7 working days prior to arrival.
b) Dimora Italia must provide the Customer with all the necessary information regarding the public transport available to reach the chosen apartment;
c) Check-in is available every day from 3.00 p.m. to 8.00 p.m.
d) For arrivals between 8.00 p.m. and midnight there is an additional cost for "late arrival" of Euro 50, to be paid in cash upon arrival. We organize arrivals between midnight and one o'clock with an additional cost of Euro 100, after this time Dimora Italia reserves the right to accept the customer always with a supplement to be quantified according to the time of arrival.
e) On the day of departure, the Customer must leave the apartment by 11.00 a.m.
f) At the Customer's request, Dimora Italia can arrange private transfers by water and land taxi. Customers are required to pay for the taxi service directly at the end of each trip.
CONDITION OF THE PROPERTY
a) The flat cannot be used by more people than indicated in this transient lease agreement without the consent of Dimora Italia. Minors must always be accompanied by an adult.
b) Pets are not allowed unless previously agreed with Dimora Italia. In case of acceptance, there is a surcharge.
c) In case of improper use of the apartment, Dimora Italia will have the right to terminate the contract immediately and without notice. In this case, the Customer will not be entitled to a refund for the remaining period of stay.
d) It is strictly forbidden to sublease or transfer the reservation to third parties.
e) The Customer expressly exempts Dimora Italia from any liability for direct or indirect damage that may be caused by third parties, gas leaks, toxic emissions, fires, floods, explosions or other, as well as by direct or indirect damages, and by blameless interruptions of services.
ADDITIONAL SERVICES
a) If you are booking additional services such as transfers, excursions, or cleaning services, please refer to the general terms and conditions relating to these services.
b) Dimora Italia is not responsible for any damages or accidents resulting from the customer's use of these services.
MAINTENANCE WORK
Dimora Italia reserves the right to carry out extraordinary maintenance work on buildings and/or systems without the Customer's consent, provided that these works are caused by reasons beyond the Company's control and that they are not detrimental to the Customer.
CLEANLINESS AND BEHAVIOUR
Conditions of Delivery and Return of the Accommodation:
The accommodation will be delivered to the guest by the company Dimora Italia in clean and tidy conditions. The accommodation must be returned in the same order condition in which it was delivered.
Rules of Conduct:
a) Correct Use of the Accommodation: The guest who signs the booking form is responsible for the correct and appropriate behaviour of all guests using the accommodation.
b) The guest undertakes to respect the good neighbourly rules, the provisions of local authorities and condominium regulations, in compliance with the laws in force. The guest is required not to disturb other tenants or create unacceptable or annoying situations.
c) The guest cannot use condominium spaces not appurtenant to the rented accommodation (cellars, corridors, parts of the garden for exclusive use, etc.).
d) The guest is not allowed to keep any type of pet in the accommodation, unless expressly agreed in writing.
e) Any modification or removal of furniture or objects in the accommodation is not allowed without authorization.
f) The guest is not allowed to make any type of modification, innovation, or improvement to the accommodation without written permission from the company Dimora Italia.
Obligation to Indemnify:
Any damage or deterioration of the accommodation or its furnishings caused by the guest or their guests during the stay will be subject to compensation to be paid by the guest and will be retained from the security deposit.
Final Cleaning
The cost of the final cleaning, as indicated in the booking, includes a professional cleaning of the accommodation with eco-sustainable products, the set of linen, towels, bathroom, and kitchen products.
Notification of Defects or Problems:
The guest is required to inform the company Dimora Italia of any defects or problems related to the accommodation within a maximum of 12 hours from the time of check-in or the delivery of the keys. In the absence of such communication, the accommodation and its furnishings will be considered as delivered in perfect condition.
Right to Claim Reimbursement or Remediation:
The guest will not be entitled to claim any refund or compensation for any disputes filed after the end of the stay, unless a defect or problem is reported within the specified period.
TOURIST TAXES
Enforceability of Tourist Taxes:
During the stay in the accommodation booked through the company Dimora Italia, the guest is required to pay the mandatory tourist taxes to the local authorities, as specified by the laws in force.
Payment Methods:
a) Enforceable tourist taxes will be charged in addition to the rental fee, booking fees and final cleaning fees, and will be specified at the time of booking.
b) Payment of tourist taxes must be made in cash or according to the payment methods indicated by the company Dimora Italia upon arrival, in accordance with local regulations.
Calculation and rates of Tourist Taxes 2023:
Tourist taxes will be calculated based on the nights spent in the accommodation according to the following rates:
a) Venice:
- High Season:
- Adults (16 years +): 4.00 Euro per night per person
- Children (10 – 15 years): 2.00 Euro per night per person
- Children (9 years and under): No charge
- Low Season:
- Adults (16 years +): 2.80 Euro per night per person
- Children (10 – 15 years): 1.40 Euro per night per person
- Children (9 years and under): No charge
b) Florence:
- Per night/per person:
- Adults (12 years +): 5.50 Euro
- Children (11 years and under): No charge
Payment Responsibility:
The guest is responsible for paying the tourist taxes related to his/her stay, in accordance with the provisions of the local laws and regulations in force.
EXTRAS
Additional Costs:
a) All additional costs that are not included in the rental fee and in the booking fee, which may be requested during the period of stay, will be specified in this section.
b) Additional costs might include, but are not limited to:
- Additional housekeeping services
- Costs for transportation services or transfers to and from the property
- Any extra supplies requested by the guest during the stay
Payment of Extras:
If the guest requests extra services, payment must be made according to the methods agreed in advance or at the time of request.
Extras Charged on Security Deposit:
a) Should there be additional unpaid costs related to extra services, the company Dimora Italia reserves the right to charge these costs to the security deposit paid by the guest upon arrival.
b) The amount charged on the security deposit will be equivalent to the additional unpaid costs, subject to notification and specific documentation of the costs incurred by Dimora Italia for the extra services.
FINAL PROVISIONS
These General Terms and Conditions of Transient Lease are governed by Italian law with reference to the rules set forth in art. 1571 et seq. of the Italian Civil Code as applicable, as well as to regional and local measures in any case relating to tourist rentals. In the event of disputes, the jurisdiction will be of the Court of Venice. Failure to comply with any provision contained in these General Conditions constitutes a breach of the transient lease agreement and Dimora Italia shall have the right to terminate the contract with the customer without prior notice.
